Terms of Service

These Terms of Service (“Terms”) govern your use of the Lotto Runners mobile and web application (the “App”) operated by Lotto Runners (“we”, “us”, “our”).

By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

1. The service

Lotto Runners connects customers who need errands, deliveries, and transport with runners who complete those jobs. We also provide bus bookings, contract transport, and related services as described in the App.

We are a platform — runners are independent service providers, not our employees, unless we state otherwise in writing.

2. Eligibility and accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App.
• You must provide accurate registration information and keep your account credentials secure.
• You are responsible for all activity under your account.
• We may suspend or terminate accounts that violate these Terms or applicable law.

3. User roles

The App serves different types of users. Your role determines which features you can access.

• Customer Posts errands, books transport, and pays for services through the App.
• Runner Accepts and completes jobs. Must meet verification requirements before taking certain work.
• Admin Authorised staff who manage users, jobs, payments, and platform operations on our behalf.

Runner accounts require additional verification (documents, vehicle details, and related checks) before accepting certain jobs.

4. Acceptable use

You agree not to:

• Use the App for illegal, fraudulent, or harmful purposes
• Harass, threaten, or discriminate against other users
• Provide false information or impersonate another person
• Interfere with the App’s security, servers, or normal operation
• Circumvent payments, fees, or escrow rules owed through the platform

We may remove content, restrict features, or suspend accounts for violations.

5. Bookings, payments, and cancellations

• Prices, fees, and payment methods are shown before you confirm a booking.
• Payments may be processed through third-party providers (for example PayToday). Their terms and privacy policies also apply.
• Cancellation and refund rules depend on the service type and job status; details are shown in the App at booking time.
• We may hold funds in escrow until a job is completed, as described in the App.

6. Runner obligations

If you register as a runner, you agree to:

• Complete accepted jobs professionally and on time
• Follow traffic, safety, and local transport laws
• Keep required licences, insurance, and vehicle documentation valid and up to date
• Use location and navigation features only for active jobs, as permitted by the App

Failure to meet these standards may result in suspension or permanent removal from the platform.

7. Limitation of liability

To the fullest extent permitted by law:

• The App is provided “as is” without warranties of uninterrupted or error-free operation.
• We are not liable for indirect, incidental, or consequential damages arising from your use of the App.
• Our total liability for any claim related to the App is limited to the fees you paid us in the twelve (12) months before the claim, or NAD 1,000, whichever is greater, unless applicable law requires otherwise.

Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Intellectual property

The App, Lotto Runners branding, logos, and content we provide are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Privacy

Your personal data is handled as described in our Privacy Policy. By using the App, you consent to that processing.

10. Account deletion

You may delete your account at any time from Profile → Delete account in the App. You can also request deletion by emailing info@lottoerunners.com.

Deletion is permanent and removes your profile and associated data, subject to legal retention requirements (for example completed transaction records).

11. Changes to these Terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated effective date. Continued use of the App after changes means you accept the updated Terms. Important changes may be communicated in the App or by email.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Namibia, without regard to conflict-of-law rules.

Disputes should first be raised with us at info@lottoerunners.com. Courts in Namibia have exclusive jurisdiction unless mandatory consumer protection law in your country provides otherwise.
